Ask HN: [US] Serious question about government contracting

A potential client/employer wants to hire me to work on government contracts.

They claim I need to be an "employee" of the company, even though they can pay me an hourly rate, because "we do government contracting".

Is this a legal precedent? Are they covering their own ass? Mine?
