My understanding is that the 14th Amendment of the US Constitution is the clear legal basis of birthright citizenship. If a provision of the constitution can be struck down by an executive order, what basis do any laws have, and under what circumstances can we rely on them?


The same party and candidate vowed to repeal Obamacare last time he was in office. Never happened; they tried 50+ times, all unsuccessfully. Same guy claimed he'd solve the Ukraine war 24 hours after election - before getting into office. Again, didn't happen.

The only way this goes forwards is a collapse of the system itself. Which isn't impossible, but seems like a higher bar than they already ran into with the ACA.


The 14th Amendment means what the Supreme Court wants it to mean. If an executive order contradicts it, the President (or some Cabinet member) will be sued. And then the Supreme Court will decide.

You can generally "rely" on them to toe the party line for whoever nominated them. Not every time, but even in unexpected cases (like the decision that legalized same-sex marriage), it's going to be close.


How is this good for business? If a small business owner doesn't know from day to day what the legal environment is, how can they plan ahead? The economy will suffer if jobs creators like small businesses retrench.


What gave you the impression they cared about small businesses, or really any business that doesn't line their pockets in one way or another? Some have posited that they want to seriously damage the economy, potentially at a global scale, so they can buy low.


Oh, it's definitely not good for businesses, though many imagine it is. They'll tell you that it's restoring the true, original, immutable meaning of the Constitution -- which just happens to coincide with their predilections. Therefore they're getting a permanent, stable legal environment forever after.
