“there were no federal laws against creating or disseminating non-consensual explicit deepfakes”

If we’re talking about regulating AI why not start here?

They already started. I assume if she shows how the deepfake is violating copyrighted content she can win the case... she probably has a few tapes to show /s

This comment is likely to be misread; she was a city commissioner from Hallandale Beach, FL. Has nothing to do with porn. So she won't have "tapes" to show how the deepfake violated copyrighted content. That shouldn't be necessary anyway, this should be criminally prosecutable as online harassment. Under FL Bill 1798, passed in 2022. Few people will notice the trailing "/s".

The article also describes the federal DEFIANCE Act ("Disrupt Explicit Forged Images and Non-Consensual Edits" Act of 2024), which would allow victims to claim damages and file temporary restraining orders against their harassers. But getting tech companies to enforce that might require CDA Section 230 immunity to be legislatively altered to exclude non-consensual AI porn.

So, Congress still hasn't passed proper protections.
