Hopefully that's the critical bit. If the defendant neither acted to impair his driving ability, nor was actually impaired, it'd be a sh*tty move to punish him.

So...why and how did the Belgian legal system charge him with drunk driving?


He had to breathe in a breathalyzer - a standard procedure in Europe during most traffic stops, no cause needed at all. The police charged him and he defended himself.
