Honestly, this is kind of a genius punishment. Monetary damages can't accurately capture the real damages union-busting causes, and if you tried to just increase them until they "match" damages that can't be remediated, you'll just send the company bankrupt and nobody wants that. I know it's naive and absurd to be hopeful about anything in American politics, but maybe a punishment like this could actually have teeth.
