First, young people have a First Amendment right to information that S.B. 152 will infringe upon.

Is that true? I was under the impression that all Constitutional rights seem to apply primarily to adults, and that their application to children is handled on a kind of ad hoc basis.

Also, does the First Amendment guarantee a right to information? There's "speech" and all that, but the Supreme Court has made it pretty clear that you don't have any rights not specifically guaranteed by the letter of the law.

It would certainly be just if kids had the right to access information and speak and all that, but we're talking about law, not justice.


Speakers have a right to speak. Closing ears can be seen as a violation of the first amendment. After all, is it really speaking if the government forces everyone not to listen?


The thing is, Utah's Governor is impossibly excited to sign this into law as soon as possible.
