If I understand this correctly, NDAs can still require them to stay silent about other illegal acts, just not harassment or discrimination?
In my opinion, we should take the opposite approach - NDAs should be limited to a whitelist of topics, and including anything else in the NDA text should not only be unenforceable, but prosecuted as an illegal attempt at intimidation of less legally-savvy employees.
