If the 737 were properly certified (without all it's grandfathered stuff from the 60s which wouldn't be certifiable today anymore) then I'd agree - the max would never fly again.

But at the end of the day, the FAA will let it fly again because it not flying might break Boeing's back and Boeing is essential as a defense company.
